Default Listing Agreement Termination

Hi quick question...

Is there a 'standard' time period (i.e 90 days etc) after a listing agreement terminates normally...where a property owner cannot sell a residential property to someone who was not presented by the listing broker during the listing period? Or is this normally a negotiated item?

I understand if another agent sells the property within 30 days of the expired listing a commision is fue but what if the owner procures the buyer without an agent?

The issue you describe is that the seller sells the property to a party AFTER the listing expires that was shown the property DURING the listing period. Most listing agreements require that the seller pay the commission to the listing broker if the party purchases within a time frame negotiated by the parties (protected period). The number of days is blank on the Florida Association of Realtors listing agreement.

Even if the seller procures the buyer, if the buyer and seller communicated during the listing period, the commission may be due if the sale occurs during the protected period.
