Florida sales exam

The answers to some of the questions were so close I didn't know which to choose, like
A Kentucky broker sends a referral to a Florida broker. Will FREC discipline the Florida broker if he pays the fee?

Two answers were "yes" and two were "no."

I know the "no" answer is right, but which one?

1) "No, since the Florida broker sold the property there was not violation."

2) "No, the Florida broker may pay a referral fee to the Kentucky broker."

Jeez! No fair. Can someone help?

2 would seem to be the MOST correct answer... Because the question is about two brokers and one being out of state.. #2 answers the question, where #1 could be about anything "not" being a violation, the answer is not "specific" about a broker being out of state.
