Default Passing rates for your school?

I am interested in becoming a realtor in Florida and have been looking at online real estate courses and noticed that some schools claim to have the #1 passing rate or a money-back guarantee that you will pass the state exam. How is your school ranked in passing and can I get some kind of money-back guarantee in case I don't pass?

The advertising that a Florida school has "The #1 pass rate..." or that it will give a "money-back guarantee that you will pass the state exam" is misrepresentation, and violates state law. Some out-of-state schools offer a distance education course for Florida students, but are not as familiar with the Florida law as you would hope.

Florida Statute 475.451(3) states:
"It is unlawful for any person, school, or institution to offer the courses described in subsection (1) or to conduct classes in such courses, regardless of the number of pupils, whether by correspondence or otherwise, without first procuring a permit, or to guarantee that its pupils will pass any examinations required for licensure, or to represent that the issuance of a permit is any recommendation or endorsement of the person, school, or institution to which it is issued or of any course of instruction given thereunder."

Obviously, if you are offered a refund if you fail the state exam, that would violate Florida law.

The DBPR does not provide schools with their passing statistics, or for other competing schools in the state, so that statement would seem misleading.
