A class action lawsuit was recently filed against a major Florida brokerage firm alleging that transaction fees charged by the firm in addition to the real estate commissions constituted fraud. The suit asks that all commissions and transaction fees charged be refunded to consumers. The Florida Association of Realtors suggests that licensees disclose the amount of the fee early, probably at the same time as the notice of nonrepresentation. The fee must bear a relationship to the services provided.
